Rental Terms & Conditions

These Terms & Conditions govern every vehicle rental from Jeep Samui Experience. By completing a booking, the Renter confirms that they have read, understood and accepted these Terms in full — including the strict off-road ban and the liability provisions below. Please read them carefully before paying.

1. General Provisions

These Rental Terms & Conditions (the "Terms") apply to every vehicle rental provided by Jeep Samui Experience, part of Harmony Life, Koh Samui, Surat Thani, Thailand (the "Operator"), to the person named in the booking (the "Renter").

The Terms form an integral part of the rental agreement. The agreement is concluded when the Renter completes an online booking and accepts these Terms during checkout. The vehicle handover protocol completed at pick-up supplements these Terms.

All contact with the Operator takes place through the online booking system and by e-mail at robert@harmonylife.asia.

2. Renter Requirements

  • The Renter must be at least 21 years old and must have held a valid driving licence for a minimum of 2 years.
  • A valid driving licence must be presented at pick-up; for non-Thai licences an International Driving Permit is strongly recommended and may be required by local authorities.
  • A passport (or Thai ID card) must be presented at pick-up.
  • Only the Renter and any additional drivers listed in the handover protocol may drive the vehicle.
  • The Operator may refuse to hand over the vehicle if the required documents are not presented or if the Renter appears to be under the influence of alcohol or drugs. In such a case the booking is treated as a late cancellation and the booking deposit is not refunded.

3. Booking and Payment

  • Bookings are made exclusively through the online booking calendar on this website.
  • A booking deposit of 5,000 THB, paid online, confirms the booking and is deducted from the total rental price.
  • The remaining balance is due at pick-up, payable in cash only.
  • The applicable prices are those displayed in the price list at the time of booking. The standard mileage allowance is 150 km per rental day; each additional kilometre is charged at 20 THB.
  • During checkout the selected slot is held for 30 minutes; if payment is not completed within that time, the slot is released.

4. Security Deposit

  • A refundable security deposit of 30,000 THB is required at pick-up, payable in cash.
  • The deposit is refunded after the vehicle has been returned and inspected, provided there is no damage, no missing fuel or equipment, and no outstanding fees, fines or other claims.
  • The Operator is entitled to deduct from the deposit any amounts owed under these Terms — including damage costs, contractual penalties, cleaning and refuelling fees, and fines.
  • The Renter's liability is not limited to the amount of the deposit. If the Operator's justified claims exceed 30,000 THB, the Renter must pay the difference.

5. Cancellations, Changes and No-Show

  • Cancellations made at least 72 hours before the scheduled pick-up time are free of charge; all payments are refunded.
  • For cancellations made less than 72 hours before pick-up, or if the Renter fails to appear (no-show), the booking deposit of 5,000 THB is forfeited.
  • Rental extensions are possible subject to availability and must be requested at least 24 hours before the agreed return time.
  • Returning the vehicle early does not entitle the Renter to a refund for the unused rental period.
  • If the Operator has to cancel a booking (e.g. force majeure, or accident or breakdown of the vehicle before pick-up), the Renter may choose an alternative date or a full refund of all payments made. Further claims are excluded.

6. Vehicle Handover and Return

  • At pick-up a handover protocol is completed, recording the vehicle's condition, fuel level, mileage and equipment, supported by photographs. The Renter should point out any existing damage before departure.
  • The vehicle must be returned at the agreed time and place, in the same condition and with the same fuel level as at handover.
  • Late return: up to 1 hour late — an additional hourly fee is charged; more than 3 hours late — a full additional day is charged at the applicable daily rate.
  • If the vehicle is not returned within 24 hours of the agreed return time and the Renter cannot be contacted, the Operator will report the vehicle to the police as misappropriated.

7. Permitted Use

The vehicle is a cherished classic car intended for recreational driving. It may be used exclusively on the paved, sealed public roads of Koh Samui — for island cruising, sightseeing and photo or video shoots.

The vehicle must be locked when parked, and keys and documents must never be left inside.

8. Prohibited Use

The following are strictly prohibited:

  • Any off-road driving: beaches, sand, dirt roads, mountain and jungle trails, riverbeds and any unsealed surfaces.
  • Driving through floodwater, deep puddles or salt water.
  • Taking the vehicle off Koh Samui or onto a ferry without the Operator's prior written consent.
  • Racing, speed contests, drifting, driving practice or driver training of any kind.
  • Towing or pushing other vehicles or trailers.
  • Driving under the influence of alcohol, drugs or medication impairing the ability to drive.
  • Carrying more passengers than there are seat belts, or overloading the vehicle.
  • Allowing any person not listed in the handover protocol to drive.
  • Subletting the vehicle, using it for paid passenger transport or for any unlawful purpose.
  • Smoking inside the vehicle and transporting animals without prior consent.
  • Ignoring warning lights or unusual noises and continuing to drive a vehicle showing signs of a fault.

9. Renter's Liability for Damage

From handover until return, the Renter bears full financial responsibility for the vehicle, its keys, documents, equipment and accessories.

The Renter is liable for the full cost of any damage, loss or destruction that occurs during the rental period, up to the actual amount of the damage. As a classic car, the vehicle has no casco (comprehensive) cover — see the "Insurance" section — so the cost of any damage to the vehicle itself is always borne by the Renter. This includes in particular:

  • the cost of parts and labour at a workshop designated by the Operator;
  • towing, recovery, diagnostics and transport of the vehicle;
  • loss of rental income for each day the vehicle is out of service, charged at the applicable daily rate (up to a maximum of 30 days);
  • damage to tyres, rims, undercarriage, clutch and the interior, including damage caused by misuse;
  • loss of or damage to keys, documents, licence plates and equipment — at replacement cost.

In the event of theft or total loss of the vehicle caused by the Renter's negligence (e.g. keys or documents left in the vehicle, vehicle left unlocked), the Renter is liable up to the market value of the vehicle.

If damage occurs while these Terms are being breached — in particular during off-road driving, driving under the influence or driving by an unlisted driver — any insurance cover is void and the Renter bears 100% of all resulting costs, including third-party claims.

The Renter's liability is not limited to the security deposit.

10. Consequences of Breaching These Terms

In the event of any breach of the prohibited-use rules or any other material breach of these Terms, the Operator is entitled to terminate the rental with immediate effect and repossess the vehicle at any time and place, without any refund of the rental price, and to retain the security deposit up to the amount of any damage, penalties and outstanding claims.

The following contractual penalties apply:

  • Off-road driving (beach, sand, dirt tracks, trails): 10,000 THB penalty, plus the full cost of any resulting damage and specialist cleaning.
  • Taking the vehicle off the island or onto a ferry without consent: 10,000 THB penalty, plus recovery costs.
  • Driving by a person not listed in the handover protocol: 5,000 THB penalty; insurance cover is void.
  • Smoking inside the vehicle: 3,000 THB (odour removal and cleaning).
  • Driving under the influence of alcohol or drugs: immediate termination, the security deposit is retained, and the Renter bears full liability for all damage.

Payment of a contractual penalty does not release the Renter from liability for damage whose value exceeds the penalty — the Renter always bears the costs up to the full amount of the damage.

11. Fuel, Cleanliness and Equipment

  • The vehicle is handed over with a recorded fuel level and must be returned with the same level. Missing fuel is charged at cost plus a 500 THB refuelling service fee.
  • Normal use is expected. Excessive dirt — sand, mud, stains, strong odours, soiled upholstery — incurs a cleaning fee of 1,000–5,000 THB depending on the condition of the vehicle.
  • Rented accessories (e.g. speaker, cameras) must be returned undamaged; loss or damage is charged at replacement cost.

12. Traffic Fines and Administrative Charges

  • The Renter is responsible for all traffic fines, penalties, parking and towing charges incurred during the rental period.
  • If a fine or charge reaches the Operator after the vehicle has been returned, the Renter will be charged the amount of the fine plus an administrative fee of 500 THB per case. Such amounts may be deducted from the security deposit or charged to the Renter's card.

13. Accidents, Breakdowns and Theft

  • In the event of an accident, damage, breakdown or theft, the Renter must stop safely, secure the scene and immediately inform the Operator using the emergency contact details provided at pick-up.
  • In the event of an accident involving third parties, personal injury or theft, the police must also be notified immediately and a police report obtained — this is a condition of insurance cover.
  • The Renter must not admit fault towards third parties and must not arrange or commission any repair without the Operator's prior written consent. Unauthorised repair costs are not reimbursed.
  • Roadside assistance is available 24/7 across Koh Samui. A replacement vehicle is provided subject to availability.
  • If a breakdown occurs through no fault of the Renter and the vehicle can be neither repaired promptly nor replaced, the Renter receives a refund for the unused rental days. Further claims — in particular for indirect losses such as missed excursions or accommodation costs — are excluded.

14. Insurance

  • The vehicle carries the basic compulsory third-party liability insurance required by Thai law. It covers injury and property damage caused to third parties — it does not cover the rented vehicle itself.
  • Due to the vehicle's age, as a classic car it cannot be covered by comprehensive (casco) insurance. The vehicle itself is therefore not insured against damage or theft, and the Renter bears the full risk of any damage to the vehicle, as set out in the section "Renter's Liability for Damage".
  • The insurance also does not cover: the Renter's personal belongings, the loss of keys or documents, or any damage occurring while these Terms are breached.

15. Personal Data

Personal data provided during booking is processed solely for the purposes of handling the booking, payment, vehicle handover and any claims arising from the rental. Data is not sold or passed to third parties for marketing purposes. Data enquiries: robert@harmonylife.asia.

16. Final Provisions

  • These Terms are governed by the law of the Kingdom of Thailand. Disputes will first be resolved amicably; failing that, the courts competent for Koh Samui, Surat Thani Province, have jurisdiction.
  • Should any provision of these Terms be or become invalid, the validity of the remaining provisions is unaffected.
  • The Operator may amend these Terms; the version accepted at the time of booking applies to that booking.
  • These Terms are published in several languages; in case of discrepancies the English version prevails.
